In Kerala, every newly constructed residential and commercial building is subject to a one-time Building Tax assessed by the State Revenue Department upon completion. In addition, residential properties with a plinth area exceeding 278.7 square metres (approx. 3,000 square feet) attract an ongoing annual Luxury Tax under Section 5A of the Kerala Building Tax Act, 1975.

1. Understanding Kerala Building Tax vs Property Tax

Buyers often confuse Building Tax with Property Tax. They are two distinct statutory levies administered by different government bodies:

Feature One-Time Building Tax Annual Property Tax
Administered By Revenue Department (Tahsildar / Village Office) Local Self Government (Panchayat / Municipality / Corporation via K-SMART)
Frequency One-time upon completion Half-yearly / Annual recurring tax
Governing Law The Kerala Building Tax Act, 1975 Kerala Municipality / Panchayat Raj Act

2. Statutory Rate Slabs for Residential Buildings

Building Tax is calculated on the total plinth area of the structure. Under the Schedule to the Act, rates are categorised into three tiers based on local authority jurisdiction:

  • Up to 100 sq. metres (1,076 sq. ft): Completely exempt for residential buildings across all local bodies.
  • 101 to 150 sq. metres (1,077 – 1,614 sq. ft): ₹1,500 in Grama Panchayats, ₹2,400 in Municipalities, ₹3,600 in Municipal Corporations.
  • 151 to 200 sq. metres (1,615 – 2,152 sq. ft): ₹3,000 in Grama Panchayats, ₹4,800 in Municipalities, ₹7,200 in Municipal Corporations.
  • 201 to 250 sq. metres (2,153 – 2,690 sq. ft): ₹6,000 in Grama Panchayats, ₹9,600 in Municipalities, ₹14,400 in Municipal Corporations.
  • Above 250 sq. metres (2,691+ sq. ft): Base tax of ₹6,000 (Panchayat) / ₹9,600 (Municipality) / ₹14,400 (Corporation) plus an additional charge for every 10 sq.m or part thereof exceeding 250 sq.m (₹1,200 in Panchayats, ₹1,920 in Municipalities, ₹2,880 in Corporations).

3. How Building Tax Applies to Apartments and Flats

One of the most important provisions for flat buyers is Section 2(e) Explanation 2 of the Kerala Building Tax Act:

"Where a building consists of different apartments or flats, or other separate units owned by different persons and the cost of construction was met by all such persons jointly, each such apartment or flat shall be deemed to be a separate building."

This means if you purchase an apartment with an individual plinth area of, say, 120 sq.m (approx. 1,290 sq.ft), it is assessed as a standalone 120 sq.m unit (₹2,400 or ₹3,600 tax), rather than being assessed against the colossal plinth area of the entire multi-storey tower!

4. Section 5A Annual Luxury Tax

Section 5A mandates an annual luxury tax of ₹4,000 per year on all residential buildings completed on or after April 1, 1999 that have a plinth area exceeding 278.7 square metres (approx. 3,000 sq. ft). This charge is recurring every year, paid to the local Village Office.

Key buyer takeaway: Standard 2 BHK and 3 BHK apartments in Kerala (which typically measure 900 to 1,900 sq.ft) fall well below the 3,000 sq.ft ceiling and are 100% exempt from annual luxury tax. Luxury tax primarily impacts expansive independent villas and premium duplex penthouses.

Frequently Asked Questions

Who pays the building tax on a new flat: the builder or the buyer?▾

How is plinth area measured for Kerala Building Tax?▾

Plinth area is defined under Section 2(k) as the area of the building measured from the external faces of outer walls at floor level, including balconies and verandas. Open terraces and car porches with non-permanent roofing are typically subject to specific statutory exclusions.

Where is Kerala Building Tax paid?▾

Building Tax is assessed by the Taluk Tahsildar and paid to the respective Village Office where the property is situated. You receive a formal receipt with an assessment order number.

Is Kerala Building Tax payable on resale flats?▾

No. Building Tax is a one-time tax assessed upon completion of construction. Once paid by the builder or original owner, a second-hand/resale buyer does not need to pay Building Tax again. You only pay recurring Property Tax and transfer registration charges.
